DISCLAIMER AND RELEASE OF LIABILITY
IN FAVOR OF TRANSGLOBAL TRADING INC. (dba URBAN CAPSULE)

Transglobal Trading Inc., an Ontario company doing business under the name Urban Capsule (hereinafter referred to as “Urban Capsule”) offers and sells a wide array of office pods and accessories. The office pods and accessories are available for purchase via the website www.urbancapsule.ca (hereinafter referred to as the “Website”), a website operated by Urban Capsule. By using, accessing, visiting or otherwise benefiting from the Website, you, the buyer (hereinafter referred to as the “Buyer”) agree to be strictly bound by the terms set forth in the present Disclaimer and Release of Liability in favor of Transglobal Trading Inc., doing business under the name Urban Capsule.
THIRD PARTY FINANCING. The Website provides links to third party mortgage brokers, lenders and financial advisors (collectively referred to as the “Third Party Financing”). The Third Party Financing may offer buyers a wide range of financing options, which may consist of and without limitation, an additional mortgage, refinancing an existing mortgage, any loan security form or collaterals such as a commercial product loan, or any other financing option. Any Third Party Financing links featured on the Website or provided by Urban Capsule, whether via the Website or offline, are provided exclusively for reference and information purposes. The Third Party Financing referrals or links should not be interpreted as an endorsement of the Third Party Financing by Urban Capsule.
SEPARATE AND DISTINCT ENTITIES. Urban Capsule does not provide any guarantees, assurances or promises regarding the Third Party Financing and any services offered, performed, executed, or provided by such Third Party Financing. The Buyer recognizes, acknowledges and agrees that the Third Party Financing is and shall remain fully separate and distinct from Urban Capsule. Urban Capsule is neither affiliated nor associated with the Third Party Financing.
ASSUMPTION OF RISK. Urban Capsule shall have no control over the Third Party Financing’s provision of services, performance of services, provision of advice, the outcome of such services and any interactions involving the Third Party Financing. Considering Urban Capsule and the Third Party Financing are separate and distinct entities, the Buyer agrees that any usage, communication with or involvement with the Third Party Financing shall be at the Buyer’s sole risk and expense, to Urban Capsule’s full and complete exclusion.
LIABILITY. The Buyer understands and acknowledges that any transaction with the Third Party Financing shall be between the Buyer and the Third Party Financing exclusively. Urban Capsule shall not be a party to any such transactions involving the Buyer and the Third Party Financing.
In consideration of the above, Urban Capsule shall not be liable for any direct, incidental, indirect, incidental, special or consequential damages, financial loss, loss of profits, impairment, or damages of any nature arising out of or relating to the Third Party Financing, and any transaction between the Buyer and the Third Party Financing. Urban Capsule shall not be responsible for any negligence, misconduct or wrongful act performed by the Third Party Financing.
RELEASE. Recognizing that Urban Capsule is solely providing a link or referral to the Third Party Financing for information purposes, the Buyer fully releases and discharges Urban Capsule from any and all claims, losses, damages, liabilities, obligations, rights, remedies and causes of action of every nature, that the Buyer may have, has had or has arising out of the Third Party Financing, the advice or services provided by the Third Party Financing, and dealings between the Third Party Financing and the Buyer.
The Buyer confirms having carefully read this Disclaimer and Release of Liability in favor of Transglobal Trading Inc. (dba Urban Capsule) (hereinafter referred to as the “Disclaimer”), and the Buyer agrees to abide by the terms of this Disclaimer. This Disclaimer shall be governed in accordance with the laws of the province of Ontario (Canada).
This Disclaimer is confidential and may not be disclosed to any third party, without Urban Capsule’s prior written consent.
